- I.
General Terms and Conditions:
i.National Center for Traditional Arts (“NCFTA”) provides services for members based on the VIP Membership (Fee-based Members) Terms & Conditions (“Terms”). A member upon completion of registration or using the services as stated in the Terms is considered as having read, understood and completely accepted the Terms, including the ones that are already in force or may come into force in the future. NCFTA reserves the right to modify or alter any part of the Terms at any time. Notification of such modifications or alterations shall be posted on the NCFTA website as and when they occur. Members are advised to check the website regularly for any updates of the Terms. The member may terminate the use of the services at any time when they do not agree to the modification or alteration or any other part of the Terms by providing notification to NCFTA through electronic or physical means.
ii.Applicants less than 20 years of age registering for a membership or registering to use the services or to continue to use the services shall be accepted only after the parent (or custodian) has read, understood and agreed all parts of the Terms and modifications or alterations.
iii.Governing Law and Jurisdiction: You and the NCFTA official website agree that the Terms shall be governed and construed in accordance with the laws of Taiwan, and the Taipei District Court shall be the court of competent jurisdiction for the first instance.
II.Considering confidentiality of the collection of your personal information and the protection of your privacy and rights, and in respect to the Article 8 of Taiwan’s Personal Information Protection Act, NCFTA shall clearly inform you the following issues:
i.Purpose of Collection: The use of the collected personal information is restricted to marketing; client management; online ticketing; and to survey, statistics and analysis on electronic commerce (See Business Specific Purpose and Code 040, 090, 148, 157). NCFTA shall collect personal information through membership registration or transaction.
ii.Scope of Collection: NCFTA shall collect the following personal information:
- C001: Personal identification, such as the member’s name, physical address, phone number, and e-mail address.
- C003: Government-issued identification, such as national identification number and tax ID number.
- C011: Personal description, such as gender and date of birth.
Time Period, Area, Target and Way of Use:
- Time Period: NCFTA shall collect the relevant personal information until six months after the member party requests a termination of the use of the services or the NCFTA terminates the services.
- Area: The collected personal information shall be used in Taiwan, Penghu, Kinmen and Matsu only.
- Target and Way of Use: The member’s personal information shall be used by NCFTA only for management support and query processing purposes as well as membership identification, marketing, cash-flow planning and logistics services, including but not limited to distribution of advertising campaigns and program information. NCFTA may provide the relevant personal information to its service partners to achieve the purposes stated herein. Examples are as follows:
A.The member agrees that NCFTA may provide the relevant personal information to the ticketing system of National Theatre and Concert Hall (“NTCH”) for the purpose of sending birthday coupon.
B. The member agrees that NTCH may provide the member’s ticket-purchasing or the other transaction records to NCFTA and the websites operated by the subsidiaries of the Ministry of Culture for the purpose of running rewards programs and marketing-related services through gathering, processing or using of such information.
The Data Subject’s Right Concerning the Use of their Personal Information: The data subject may exercise the following rights to NCFTA according to Taiwan’s Personal Information Protection Act:
- Accessing or reading the information.
- Requesting Copies of the information.
- Requesting complement or correction of information.
- Requesting termination of collecting, processing or using the information.
- Requesting deletion of the information. Any member who wants to exercise the above rights, please make an application to NCFTA.
※ Attention! Refusal of providing the required information upon registration may entail the impossibility of accessing the services for which the data is required.
III.The applicant shall complete registration and give consent to the following terms before using the complete services provided by NCFTA:
i.To provide the correct and updated information as stated in the registration list and not to register in the name of a third party. Only one account number is assigned to each applicant. Double registration is not allowed.
ii.The member is advised to keep his/her personal information updated in order to receive the best services.
iii.The member agrees that NCFTA has the right to suspend or terminate his/her account number and refuse the member to use part or all of the services upon double registration or incomplete, inaccurate or incorrect information given during his/her registration.
IV.NCFTA shall be responsible for the operation of the website and services through technologies and procedures at reasonable costs. For the following situations, NCFTA has the right to suspend or terminate the services:
i.During the period when NCFTA performs necessary maintenance or engineering on the electronic and communication systems.
ii.Unexpected malfunction of the electronic and communication systems.
iii.NCFTA’s electronic and communication service provider terminating the services.
iv.If a force majeure event occurs or for reasons not attributable to NCFTA which prevents NCFTA from complying with any of its obligations of providing services stated in the Terms, including but not limited to natural disasters.
V.Alteration of Services and the Distribution of EDM and Printed Literature:
i.The member agrees that NCFTA shall add, reduce, change or terminate part of the services stated in this agreement without prior notification.
ii.The member agrees that NCFTA shall add, alter or terminate related activities according to actual implementation. NCFTA shall notify members in the most suitable way possible.
iii.The member agrees to receive EDMs sent to their electronic or physical address on irregular basis. If a member expresses an unwillingness of receiving such marketing campaigns, NCFTA shall terminate sending him/her such information. The member who terminates subscription of an E Newsletter shall still receive Notice about Membership Rights and Benefits to ensure their rights and benefits.
VI.Miscellaneous:
- The application form and collected documents shall not be returned, and we shall retain the right of final decision over an application.
- We retain the right to alter or terminate membership-related campaigns and the right to issue or terminate any membership.
- We shall update or alter membership-related campaigns on irregular basis, which will be posted on the NCFTA website.
